The subject is exhaustively dealt with by different schools of thought and each of which appears to be valid explanations of human behavior. Dr. Abraham Maslow (Halonen Santrock, 1996) made a strenuous effort to arrange human motives in a hierarchy from stronger and lower at one end to weaker and higher at the other. Maslow essentially suggested that what man really wants is more of everything. Man desires a better and better situation for himself. He wants only what he does not already have, and thus satisfied needs do not motivate behavior. Maslow said that needs or wants can be arranged in a hierarchy of importance. Thus, when needs on the lower level are fulfilled, those on a higher level emerge and demand satisfaction. The hierarchy of needs he suggested placed physiological needs as lowest or basic, then safety needs, social needs, esteem needs, and finally self-realization needs. Man is free to chart his course and how he is supposed to fulfill his various needs; i. e. his physiological dimension. In addition, the manner with which he carves himself in a particular niche that satisfies his psychological domains is also based on his own volition. There is no flavor of unconscious thoughts pervading motivation like when the idea of psychological instincts being interpreted within Maslow’s understanding; in contrast to this notion, any individual can basically control their own behavior. Maslow’s theory believes on the capacities of human nature to achieve what man wants to achieve rather than be held captive by forces within him or in his external world; it is the internal determinants such as self-determination that separates the theory from the rest especially among those with the deterministic stance (Halonen Santrock, 1996). Hereditary or Environmental: are the characteristics a person has inherited and inborn or is it developed by social influences? Since the premise of this theory hinges on freedom, a person’s characteristics therefore are developed by social influences. According to Maslow then, people vary in their manner of satisfying their needs because of various environmental influences that surround him/her. Man is free to choose from several options adequately provide for his own needs or desires. What are essentials though, are man’s tendencies or propensity to follow the order of needs. Biology or heritability is deemphasized, rather the value of experience is pre-eminent in the theory (Halonen Santrock, 1996). Uniqueness or Universality: individuals are unique or people are all pretty much the same This theory eventually emphasizes individuality or uniqueness, as it fundamentally illustrates in its assertion that every one has the capability for breakthroughs in circumstances which may be difficult. Man is also capable to understand himself and others, showing a lot of hope on the potentials that man possesses that he can exhaust in his lifetime (Halonen Santrock, 1996). Proactive or Reactive: individuals act on their own initiative or just in reaction to external stimuli? Since man is free, unique and has the possibilities to accomplish whatever he is set to do, it is also asserted that man is proactive: he can choose how to respond in any situation and may even extend himself to advance his interests, both positive and negative at whatever goal or in whatever circumstance he may be in (Halonen Santrock, 1996). Optimistic or Pessimistic: individuals can change given the right environment or they are unchangeable? The Hierarchy theory by design is hopeful and positive in every essence, if one is to follow the line of thinking which Maslow attempted to direct his audience. Individuals then have all the chances to make their lives fulfilling, impact others on virtues of honesty, charity and generosity, if and when he determines himself to be one. Likewise, he can also influence and negatively affect those that surround him when he chooses to do so. In this perspective then, an individual has high hopes of changing his attitudes and disposition, as well as his physical arrangements in life (Halonen Santrock, 1996). Part II. Evaluation of the theory If this theory is to be evaluated, the strength of Maslow’s assumptions lies in his recognition of the positives that humans possess. It reminds the audience of the person as a whole being and not just an organism subject to either what the psychoanalysts termed as instincts or behaviorists’ position as merely organismic. The emphasis on developing the potentialities mark Maslow’s crowning achievement in terms of theoretical appeal (Halonen Santrock, 1996). However, there are obvious or clear discrepancies or weaknesses in the theory. Since Psychology claims to start and end as a scientific endeavor, thus following scientific procedures to provide proofs to any of its claims, then Maslow’s theory must be ready to be tested accordingly. And this is where his theory fails in almost every measure in essence. At the outset, this viewpoint of explaining behavior is difficult to measure or put to test. Specifically, despite the details and emphasis Maslow placed on self-actualization the concept is still hard to operationally define. Scientists then and now are encountering various dilemmas in making the concept scientifically or empirically acceptable. In addition, there are illogical and inconsistent presuppositions in the constructs he postulated. He adheres to man’s capability to choose and yet how can he justify the existence of the structure of ordering needs in every individual if man is not born with it in the first place. How can he explain as well on those people who have achieved (jumped to the higher order needs) when they are barely existing or are starving at the same time; being altruistic and yet has no means to adequately meet their own needs (Halonen Santrock, 1996). Lastly, studies even show that many who adhere to this philosophical viewpoint shun the scientific procedures imposed on any scientific field or discipline, and choose to lean towards the clinical orientation for the explanation of specific behaviors or motivations. Others who examined this theory explained that the assumptions on human behavior are too high or exaggerating on positives or the freedom and the logical capabilities that humans possess. Maslow’s theory, especially his self-actualization concept, critics affirm, implies the tendency for man to reinforce his self-centeredness (Halonen Santrock, 1996). Conclusion If popularity and appeal are benchmarks for a theory to pass with flying colors, Maslow’s theory probably will go to the top. This is evidenced also as to the current prevalence of his theory in business; it is pervadingly present in almost every discussion in any business management course apparently (Halonen Santrock, 1996). For convenience, I too would readily fall for his theory and its seemingly simplistic way of explaining behaviors. But if I were to stick to following empirical underpinnings, I should say that the theory is not deep enough to satisfy more difficult human dilemmas, though in some instances, the theory seems to point to some aspects of life’s realities. It is not sufficient to compel me to believe in the theory enough. To illustrate, pursuing many of our own self-centered needs only frustrates us all the time and eventually makes many of us disordered and mentally sick along the way. Can I use it to predict human nature? In fairness, yes; but to a certain extent only, because as I mentioned, it is not sufficient enough to merit full dependence. The theory can probably modified to some degree as a picture of several aspects of being human, but to explain about the potentialities, may imply believing too much when all that is in there is just hot air, so to speak. Self-actualization may provide hope for those who are so discouraged in life, but it is still very limited in reality. Some even say that a by-product of this belief is a sense of irresponsibility (Halonen Santrock, 1996). Remarkably, Maslow suggested that various famous personalities illustrate what his theory posited including Beethoven, the brilliant composer, and Lincoln, one of the greatest leaders of all time. Many police agencies were able to scream loudly enough to get enough funding to keep their departments running, albeit barely. When Corrections agencies made the same call, we were largely ignored. Many states implemented a â€Å"furlough† program, or something similar, that cut the salaries of the lowest paid employees. On top of this, training was cut to an all time low, while the hiring of new officers was frozen. Simple math tells us that it was also time for a whole generation of officers to retire. They have yet to be replaced, so mandatory overtime is the norm. During the build-up of the popularity of crack cocaine in the early 80’s, crime rose to an all time high. Incarceration rates shot through the roof at the same time. This, along with tougher sentencing laws, led to a wave of prison building and hiring. By the early 90’s, most departments had outgrown themselves, and were desperately hiring as many people as they could. Those officers are now due to retire. Few states took this into consideration, so as we entered this year under budget cuts, we were expected to do more with less — much less.So was 2010 a loss? Not exactly. Through all of this, the community has learned an important lesson if they choose to look. In almost any other profession, these reductions in pay, along with an increase in danger at the working environment, would have led to catastrophic work stoppages, or large scale protests. But no one walked away from their duties. No one went on strike. And to the best of my knowledge, there were only a few small scale protests by officers. At the end of the day, feeling underappreciated and underpaid, correctional officers punch the clock after protecting society from those they have incarcerated. With many of the resources cut or gone, we went about our business and did our job. Yes, some mistakes were made. Many were due to a lack of resources or just plain tired officers making mistakes. With fewer resources in place, and with less staff, the average officer worked even harder than usual, and did so at a discounted salary.No walk-outs, no â€Å"blue flu,† no rebellion. I would never have expected less from us as a group, but others are starting to take note. People who have never dealt with corrections are starting to understand our predicament. It was not because we sat on the floor and threw a temper tantrum about our working conditions, but it was through our continued dedication to the safety of the public, regardless of what was thrown at us, that people are starting to take note of us. 2010 was the year of the Correctional Professional. I have never been prouder to be part of a group of people than I am today. I realized this about 6 months ago when I overheard several officers talking. The officers were discussing a major union conference that had just taken place. During this conference, the possibility of striking had come up. It was decided at this conference that the membership of this union could vote to strike if they felt it necessary. The officers were discussing the possibility of a strike. By the time the 5 minute conversation was over, all of the officers walked away agreeing that there was no way they would ever strike, even if it was legal to do so. The reasons ranged from not wanting to leave their brothers and sisters behind, to feeling that they were officers first, union members second. Do you think this conversation would have been the same had it been on the floor of a factory?This sentiment quickly spread throughout the state, and it was made clear to this union that striking is not now, and never will be an option; it would be better to resign. This came out of the mouths of officers who, like me, had suffered a 15% pay reduction, an increase in their medical payments, and an increase in retirement contributions. Many officers have lost their homes, or have had members in their family, or themselves, take on another job. Through it all they are still dedicated.This is why this has been the year of the Correctional Officer. Although this has been a tough year, and things are not looking any better for next year, people on the outside are getting to see us for who we really are. History of France France has a long history and according to the  U.S. Department of State, it was one of the earliest countries to develop an organized nation-state. By the 18th century, though, France began having financial problems due to the lavish spending of King Louis XIV and his successors. These and social problems eventually led to the  French Revolution  that lasted from 1789 to 1794. France was hit hard during  World War I  and in 1920 it established the  Maginot Line  of border defenses to protect itself from the rising power of Germany. In 1940 it was divided into two sections - one that was directly controlled by Germany and another that was controlled by France (known as the Vichy Government). By 1942 though all of France was occupied by the  Axis Powers. In 1944 the Allied Powers liberated France. Following WWII a new constitution established Frances Fourth Republic and a parliament was set up. On May 13,  1958,​  this government collapsed due to Frances involvement in a war with Algeria.  As a result,​  General Charles de Gaulle became the head of government to prevent civil war and the Fifth Republic was established. In 1965 France held an election and de Gaulle was elected as President but in 1969 he resigned after several governmental proposals were rejected. Since de Gaulles resignation, France has had seven different leaders and its recent presidents have developed strong ties to the  European Union. The country was also one of the EUs six founding nations. In 2005 France underwent three weeks of civil unrest as its minority groups began a series of violent protests. In 2017  Emmanuel Macron  was elected president. Government of France Today France is considered a republic with an executive, legislative and judicial branch of government. Its executive branch is made up of a chief of state (the president) and a head of government (the prime minister). Frances legislative branch consists of a  bicameral Parliament  made up of the Senate and the National Assembly. The judicial branch of Frances government is its Supreme Court of Appeals, the Constitutional Council and the Council of State. France is divided into 27 regions for local administration. As well as PE, we spent up to 3 hours a week at training and another 3 hours on Saturday for competition. Can you imagine students academic performances if we were to spent 6 hours a week doing homework or study? And it is not only the actual time you are at training that counts, because often, after training you are tired and cannot be bothered to do homework or study, again dragging down our academic results. If sport was optional, then the people participating in the teams would be the people that wanted to be there, the people who wanted to play and win. Wastewater Management Essay In this age of rising costs and depletion of natural resources due to over use by the ever growing population on our planet, it is absolutely essential that we find ways to recycle and conserve wherever possible. One way of doing this is by managing wastewater. The first step in the process replicates what occurs in nature; the only difference is that it is faster. In this initial step, called primary treatment, water is collected in huge tanks and the solid particles are allowed to settle by force of gravity while the remaining mixture is allowed to run off. This process removes about 60 percent of the suspended particles and is only suitable for irrigation of trees or other non consumable crops in remote areas. The secondary treatment is significantly different from the primary in that it involves the biological removal of the organic materials contained in the wastewater. The most common form is called activated sludge method, where the wastewater is placed in tanks which are aerated with oxygen to encourage the growth of microbes found in the waste. The microbes eat the organic matter and the solids are allowed to settle to the bottom. Trickling method is another option in the secondary treatment method. In this process tanks of coarse material are filled with rocks three to ten feet in depth. The rocks are used as surface area on which bacteria called biomass is allowed to grow. Next, a long arm-like distributor sprays the waste water in the air over the biomass, which feeds on the organic waste and allows the remaining liquid to trickle through the rocks. Here water is collected and then sedimentation is allowed to take place. The final method is known as Lagoons. In this method large ponds are used. Algae grows in the ponds and with the use of sunlight produces oxygen. The oxygen then is used by the microbes in wastewater to breakdown the organic material and the solids then settle at the bottom of the pond. After applying the primary and secondary methods the water then is treated with chlorine or other disinfectants. The tertiary treatment goes beyond what is done in the secondary treatment and can involve chemical, physical or biological processes to further remove contaminants, Tertiary processes include filtration, lagooning, nutrient removal and disinfection. Filtration is a common tertiary treatment method. Water is allowed to pass through sand or activated carbon, which allows the particles in water to stick to the filer material used and water to pass through. In some cases the excessive levels of nitrogen and phosphorous must be removed before releasing the water to the environment. If water is released into the environment without removal of these compounds, they can cause over growth of algae and other water plants which in turn can throw the ecosystem out of balance. Some wastewater treatment plants use one tertiary method others a combination of methods. There are many uses of reclaimed water, for example it can be used for irrigation, power generation, decorative fountains, fire control, aquifer recharge, cooling or other industrial processes. Reclaimed water contains nutrients such as nitrogen, phosphorus and oxygen which help fertilize plants. The use of reclaimed water reduces pollution in areas which are sensitive. It cannot be used in swimming pools, or other places where it comes in contact with the body, cooking, drinking, or irrigation of herbs and vegetables. Recent studies show there may be a possible public health effect when using reclaimed water. It has been known for some time that treated wastewater effluent, or reclaimed water, contains pathogens that could be transferred to people through contact and some parasites are not killed by chlorination A water treatment plant in Lake Tahoe, California has been producing drinking quality water from wastewater and astronauts reclaim all their wastewater and use it for drinking. Using wastewater to recharge the water basin and using that for drinking is not an issue provided WHO guidelines for the quality of drinking water are maintained. This means that tertiary wastewater treatments will have to be used before the wastewater can be used to recharge the basin. Torture is Ethically Wrong: Analysis Stephen D. Dillehayes Serving in a combat centered career in the military for almost two decades I have many experiences with the topic of torture. I have attended classes on how to apply and resist, both with varying results. But one of the topics that always come up is Is torture ethically right. I believe argument can be broken down into categories, how it affects the person and how it affects the states, which will reveal how it is fundamentally wrong. Lets look at two sides of the debate. Argument: Premise 1: Provides information in time sensitive situations. Premise 2: The ends justify the means. Premise 3: The enemy uses it, so there isnt a reason we shouldnt. Conclusion: Torture is legally and morally right. Counterargument: Premise 1: By dehumanizing someone you can collect information easier, but this also dehumanizes you. Premise 2: Human rights are suspended by the torturer to get what he wants. Premise 3: Information received validity cant be trusted. Conclusion: Torture is legally and morally wrong. The first premise of the counterargument is centered on the acts of violence inflicted by the torturer. To be affective as a torturer you have to think of your victim as less than human, in order to justify the human rights violations you have to commit to get any useful information. This process have been seen throughout history, the most notable is the Nazis treatment of the Jews in World War II. These actions can led to not only war crimes, human rights violations but also legal ramifications which will have long term effects on the person i.e. criminal charges and psychological damage. For the second premise you have to look at human rights on a global scale. The United Nations, in 1948, wrote the Universal Declaration of Human Rights. One of the Articles contained in it is Article 5, which states No one shall be subjected to torture or to cruel, inhuman or degrading treatment or punishment. In particular, no one shall be subjected without his free consent to medical or scientific experimentation. (UDHR, 1948). The United States of America was one of the members who helped draft and signed this collections of rights. By denying to fall it and allowing personnel within its government or military to use torture as a mean to get information the United States government as a whole is guilty of human rights violations. The last premise can be summed up from the Army Field Manual 34-52 Chapter 1, Experience indicates that the use of force is not necessary to gain the cooperation of sources for interrogation. Therefore, the use of force is a poor technique, as it yields unreliable results, may damage subsequent collection efforts, and can induce the source to say whatever he thinks the interrogator wants to hear. (AFM 34-52, 1992) This statement comes from an organization, the U.S. Army, which has been at war no stop with terrorism for over a decade and they dont even believe torture is an effective way to get information. It is hard to get a better first hand source then that. All of these lead to the conclusion that the argument is fundalmentally flawed. If you look at the main points you can see how they dont support the conclusion, whereas the counter argument not only supports but validates its conclusion. One, provides time sensitive information, which cant be trusted. Two, the ends justify the means, the same argument the Nazis use, which didnt make it right. Finally, our enemy use it so we should. This mindset was ban by the UN, which the US is part of, which makes the premise invalid. By looking at the evidence provided, which shows that torture dehumanized a person, but is globally wrong based off of articles of the UN, there is no other conclusion then torture is wrong. Not only on a personal standard, from what it does to someone. But since the USA has already signed an agreement banning it, it is legally wrong at the state level as well. Migration Similarities of Island People Works Cited Not Included I will compare the migration experiences of the Tongan island people as illustrated in Voyages: From Tongan Villages to American Suburbs with the migrants of the Dominican Republic that Peggy Levitt discussed in The Transnational Villagers. I will further describe how many of their encounters mirrored the life of "Dan," an island native that shared his transnational knowledge by describing the social remittances, international connections and migration he experienced. Dan is a native of Ireland. He is a legal alien living in Arizona. He grew up surrounded by the influences of a transnational family. Migration was viewed as an acceptable and natural step in a motivated Irish person’s rite of passage. This is also the clear message of Small (1997), she noted that migration became an essential part of what it meant to be Tongan and the excitement of living overseas might be the best way to fulfill a Tongan life. (p. 43) Dan's migration influence seemed to stem from his grandfather, who worked in a post-office when letter writing was the major form of communication. He would narrate and respond to letters from overseas, as requested by his neighbors. Many of these letters were from the Irish-Americans that had emigrated in large numbers to the United States over the decades. In 1911 for instance, the number of Irish-born persons living abroad was equivalent to 50% of the population that lived in Ireland at the time (Courtney, 2000). The international correspondence Dan’s grandfather processed, he often shared with his family. This may have sparked the desire in his daughters, one of which was Dan's mother to travel to the United States many years later. ... ...ain, Canada, Australia and the United States, during this time the population in the Republic of Ireland was only 3.53 million (Courtney, 2000). In1995, more than one-quarter of the entire population of Tonga, both Tongan born and American born were living in the U.S. (Small, 1997). Levitt (2001) pointed out that eight and a half percent of the Dominican Republic’s population lived in the United States, but they do not necessarily intend to stay in the U.S. (p. 22) Americans tend to have a belief that their country is superior, consequently we believe that everyone, if they could, would be a U.S. citizen (Small, 1997). As Dan proved, this is not the case, although he felt that it was his destiny to come to the United States, after 13 years of residing in America, he has no doubt that his identity remains that of an Irish man in America and not an Irish-American.

Dram shop laws are instituted for all places which serve alcoholic beverages including restaurants, taverns and bars. An employee of these establishments may not serve alcohol to minors or those ‘visibly intoxicated’. If the person which consumed the beverage leaves the establishment, gets in an accident or causes bodily harm to another person, the establishment and the server may be held liable for damages. However, this should not be the case. Those who were intoxicated and caused the accident should be the only ones held liable for damages he or she caused to another person. Too many people take advantage of the legal proponent which allows these places which serve alcohol to be held liable. I would like to remove this proponent and make a revision to Montana’s Dram Shop laws, making it better for servers and consumers alike. In the following I will tell you some positive and negative outcomes if this change ever were to occur. I am going to answer the question of the whether Montana should have the liability clause which puts establishments at risk of being held financially responsible. In order to come to a conclusion, both sides must be heard. I will begin why we should remove these laws and positive outcomes. Should Montana in fact have liability clauses which enable the tavern or bar to be held liable? The job of a bartender can be a tedious and stressful one. By removing the liability element of the Dram Shop laws, bartenders can focus on their jobs instead of on attempting to recognize the signs of someone who is ‘visibly intoxicated’ (Rumberger: Kirk & Caldwell). This becomes especially difficult on a bustling Saturday evening when the bass of the band is thrumming in your ears and ten different people are calling out, â€Å"Bartender! On busy Saturday nights, not only are the bartenders kept busy, but the tills are as well. Businesses make quite a bit of money on nights like these; however the liability clause can put a damper on the profits of small, local businesses. Part of a bartender’s whole job is to encourage the buying of alcohol, and the drinker should respond by leaving when he or she has noticed they have developed that ‘buzzed’ feeling. The bartender’s job is simple; tend the bar and comply with the wishes of your customers. When servers have to cut off drinkers, feelings are often brushed and money lost. When someone gets particularly offended, physical altercations can often occur, posing a major health safety risk for all those in the bar. With these laws in place, often bartenders and bouncers put their welfare on the line when it comes to removing drunken patrons. When is seemingly too intoxicated to continue drinking, it is the duty of the bartender to refuse any further service to the customer. Even though this is required by law, it can often result in one if not both, of the parties involved to leave with a bump or bruise, if not worse. When it comes to injuries in public establishments, people these days seem to get all together ‘sue-happy. ’ Without these laws putting liability on establishments which took no part in the maiming of others, the person who actually committed the offence will be the only one who can be held responsible. There are many cases which someone is offended, injured or leaves and commits another crime which can then be financially supported by the small business. Now that I have gone over the positives, I will now explain the negative effects of the removal of this element of the Dram Shop laws. We all know drunk driving is an all too common occurrence in the United States. Most people probably don’t know that a studies conducted have shown that nearly 80 million trips a year are made with a driver having consumed some amount of alcohol (Major Mark Willingham). This means that all establishments must do their part in making these numbers go down. By keeping these laws, bartenders will continue to be pressured to keep people better under-control in bars and taverns. Bartenders are specially trained to recognize the signs of people when they are beginning to show signs of intoxication and how to handle the following situations. Without these laws, employees will lose the proper training by employers with the lack of enforcement (CADCA). These guidelines can help to quickly clear up situations which pose a threat to the server or those also in the bar. As an establishment which serves alcohol, taverns and bars have an obligation to their customers to perform all aspects of proper service (expertpages. om). When someone comes into a place to be served alcohol, bartenders should be able to aid in helping for these customers get home by cutting them off. They are also supposed to provide any service which is asked, usually complied with a cheery demeanor. All these aspects create the foundation for proper service in these establishments. With the concept of liability, these laws do not only hold the person who committed the crime or offence, but can help to keep bars and taverns in check and doing their jobs. Some terms that must be corrected before this law becomes valid are the concept of ‘visual intoxication. ’ There is no clear definition by which you can define someone as visibly drunk, some people are just morons. Some people act more or less drunk than they are. The legal drinking age of 21 must also be clearly stated. I still believe that the liability aspects of Dram Shop laws should be removed. Bartenders keep clients in line as much as possible, but should not suffer blame and loss of business in order to make an educated guess at the intoxicated state of another person. Too many people have taken advantage of these small businesses and there needs to be only one person, the one truly responsible, to be held liable. When these establishments get slam-jammed busy, there is no way for one or two people to properly assess the mental state of someone, especially a stranger. Enough pressure is applied to these businesses in economic times like those we are in. we should take away the possibility that someone could take business, money and good name of any bar or tavern.
